Interest Rates and Interest Charges

Annual Percentage Rate (APR) for Purchases: 0%

At launch, purchases made using the EB1 Card do not accrue interest. The Issuer reserves the right to introduce interest charges on future purchases in accordance with applicable law and the Issuer’s terms.

Any introduction of interest or other charges will be disclosed to you in advance through updated cardholder disclosures and/or amendments to the applicable terms, and will apply only to purchases made after such changes take effect.

Fees

Transaction Fees

Certain fees may apply to your use of the EB1 Card in accordance with the terms set by the Issuer and other authorised third-party service providers, and may include:

  • Foreign exchange fee (non-USD transactions): up to 3%

  • Cross-border transaction fee: up to 3%

Such fees are determined by the Issuer or relevant payment networks and may vary depending on the nature of the transaction, currency, and merchant location.

Penalty and Account-Related Fees

Where applicable, the following fees may be imposed by the Issuer or other authorised third-party service providers in accordance with their terms:

  • Late payment fee: up to USD 40

  • Returned payment fee: up to USD 29

  • Liquidation or enforcement-related fee: up to USD 35

Any applicable fees will be disclosed to you in advance through the Issuer’s disclosures, cardholder agreement, or via the EB1 platform, and will apply only in accordance with applicable law and the relevant third-party terms.

EB1 does not itself set, charge, or collect issuer-imposed fees and does not provide credit or lending services.

Background

The EB1 Card is made available to you in connection with your status as an EB1 client, customer, or authorised user, and is subject to your separate user agreement with EB1 (the “EB1 User Agreement”), together with these Card Terms and the applicable terms and disclosures of the card issuer (the “Issuer”).

Your ability to access and use the EB1 Card and related services is subject to authorisation, controls, and limits established by EB1 and the Issuer, in accordance with their respective roles. EB1 provides access to the EB1 Card through its platform as a program facilitator and does not itself issue cards, extend credit, or assume payment or settlement obligations arising from card transactions.

All payment, settlement, and credit obligations arising from your use of the EB1 Card are owed in accordance with the Issuer’s terms and applicable agreements, and you remain responsible for satisfying such obligations in accordance with those terms.

Important: The EB1 Card is intended solely for commercial or business use. It is not designed for, and must not be used for, personal, consumer, or household purposes..

Accepting this Agreement & Eligibility

These Card Terms become effective and legally binding when you activate or create an EB1 Card by following the instructions provided through the EB1 platform. By activating or using an EB1 Card, you agree to comply with, and be bound by, these Card Terms, the EB1 User Agreement, and the applicable terms and disclosures of the Issuer.

By using an EB1 Card, you represent and warrant, in your individual and/or authorised capacity, that:

  • You are not a person or entity that is blocked or sanctioned under applicable US sanctions laws, including those administered by the United States Department of the Treasury’s Office of Foreign Assets Control (OFAC);

  • You will use the EB1 Card and related services solely for purposes permitted under these Card Terms, the EB1 User Agreement, and any applicable Issuer terms;

  • All information you provide to EB1 or to authorised third-party service providers, whether directly or through the EB1 platform, is and will remain true, accurate, and complete;

  • You will not use the EB1 Card for personal, family, or household purposes; and

  • You will use the EB1 Card in compliance with all applicable laws, regulations, and card network rules.

Collateral

In connection with your use of the EB1 Card, you may be required to maintain eligible collateral to support amounts charged to your EB1 Card (the “Collateral”). Where required, such Collateral will consist of digital assets held with, and subject to the terms of, an authorised third-party custodian or service provider designated by the Issuer.

EB1 does not itself hold, safeguard, control, value, or liquidate digital assets and does not take custody of any Collateral. EB1’s role is limited to facilitating access to collateral-related information and functionality through the EB1 platform, where applicable.

A “Liquidation Event” may occur, as determined in accordance with the Issuer’s terms and the applicable third-party provider arrangements, if:

  • You fail to satisfy a payment obligation owed to the Issuer within the applicable timeframe specified in the Issuer’s terms; or

  • The value of the Collateral, as determined by the relevant third-party provider, falls below the level required to support outstanding charges and you do not provide additional eligible collateral within the applicable timeframe.

Any enforcement, liquidation, or application of Collateral is carried out solely in accordance with the Issuer’s terms and the arrangements of the relevant third-party service provider. EB1 does not exercise discretion over, or participate in, the liquidation or enforcement of Collateral.

Spending Limits

Spending limits applicable to your EB1 Card are established and managed in accordance with the EB1 User Agreement and the applicable terms of the card issuer (the “Issuer”).

EB1 may apply platform-level controls or recommendations in relation to spending limits as part of its program facilitation role. The Issuer may also impose card-level or aggregate spending limits across one or more EB1 Cards, at its sole discretion and in accordance with its regulatory obligations and internal risk controls.

Spending limits are dynamic and may be increased, decreased, suspended, or reduced to zero at any time by EB1 or the Issuer, with or without notice, including on a temporary or permanent basis

Purchases & Restrictions

The primary purpose of your EB1 Account and EB1 Card is to facilitate legitimate corporate expenses and other bona fide business-related purchases.

EB1 and the card issuer (the “Issuer”) may monitor transaction activity and reserve the right, in accordance with applicable law, card network rules, and internal risk controls, to decline, block, restrict, or suspend transactions or access to your Account where activity appears inconsistent with business use, presents elevated risk, or otherwise does not conform to these Card Terms.

Without limitation, the following categories of transactions are considered cash-like or restricted transactions and may be declined or restricted:

  • Purchasing traveller’s cheques, foreign currency, money orders, wire transfers, cryptocurrency, or similar value-substitute instruments

  • Purchasing lottery tickets, casino gaming chips, race track wagers, or similar offline or online betting or gambling products

  • Person-to-person transfers or account-funding transactions that facilitate the transfer of currency or monetary value

  • Making payments using third-party payment or bill-payment services where the payment is not made directly to the merchant or its authorised service provider

This list is non-exhaustive. Additional transaction types may be restricted or declined in accordance with applicable laws, card network rules, or the Issuer’s policies.

Promise to Pay

You agree to pay all amounts charged in connection with your use of the EB1 Card, including purchases, fees, and any other amounts due, in accordance with the applicable terms of the card issuer (the “Issuer”) and any related agreements governing your account.

EB1 does not extend credit, act as a lender, or assume responsibility for payment or settlement of card transactions. Payment obligations arising from your use of the EB1 Card are owed to the Issuer or its authorised assignees in accordance with the Issuer’s terms.

Periodic Statements

You are responsible for reviewing and paying in full all amounts due in connection with your EB1 Card in accordance with the Issuer’s billing cycles and payment requirements.

the EB1 platform for informational purposes and may include details of transactions, fees, refunds, collateral-related information (where applicable), and other amounts owed or credited in relation to your EB1 Card.

Lost or Stolen Cards

If your EB1 Card is lost or stolen, or if you believe that your Card or account has been used without your authorisation, you must notify EB1 promptly by contacting contact@eb1.io so that appropriate action can be taken.

Subject to applicable law, card network rules, and the terms of the card issuer (the “Issuer”), you will not be liable for unauthorised transactions that occur after you have provided notice. You may, however, be responsible for unauthorised transactions that occur prior to receipt of your notice, as determined in accordance with the Issuer’s terms and applicable law.

Chargebacks

You are responsible for reviewing your periodic statements promptly and identifying any transactions that you believe are unauthorised or incorrect.

If you have a dispute with a merchant regarding a transaction, you should first attempt to resolve the matter directly with the merchant. If the dispute is not resolved to your satisfaction, or if you believe a transaction is unauthorised, you may submit a chargeback request through your EB1 Account in accordance with the card issuer’s (the “Issuer’s”) procedures, applicable card network rules, and relevant law.

All chargeback requests must be submitted within sixty (60) days from the date the disputed transaction is first posted to your periodic statement, unless a longer period is required under applicable law or card network rules.

Termination

Subject to applicable law, EB1 and/or the card issuer (the “Issuer”) may suspend, restrict, revoke, or terminate your access to the EB1 Account, your right to use the EB1 Card, or decline any transaction at any time, with or without cause and with or without prior notice, in accordance with their respective roles, policies, and regulatory obligations.

Any suspension or termination of your access to the EB1 Account or EB1 Card, whether initiated by you, EB1, or the Issuer, will not affect any rights or obligations that accrued prior to such termination. In particular, you remain responsible for satisfying any outstanding payment obligations owed to the Issuer or its authorised assignees in accordance with the applicable Issuer terms and agreements.

Governing Law

These Card Terms shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), which are based on principles of English common law, without regard to conflict of law rules.

Nothing in this section limits the application of any mandatory laws, regulations, card network rules, or the governing law provisions of the card issuer’s terms, which may apply in parallel or take precedence where required.
