Your affirmative consent to this E-sign & Electronic Communications Notice ("Consent") permits EB1 to provide you with Communications electronically, enables you to sign and authorize Communications electronically through the use of our Platform, and allows EB1 and its partners to collect such e-signatures. If you do not consent to the electronic delivery of Communications, you will not be able to use the service.
By registering for an account, applying for a card, or accessing the Platform, you agree that such registration constitutes your electronic signature, and you consent to us providing notices to you and any relevant administrators or users electronically. You understand that this consent has the same legal effect as a physical signature.
Your consent to electronic delivery
Thank you for applying for EB1 services. By providing your consent to this E-Sign & Electronic Communications Notice (this “Consent”), the terms set out below will apply even if you do not ultimately obtain, or are not offered, access to EB1 services.
Your affirmative consent authorises EB1 to deliver communications to you electronically, enables you to sign and authorise documents electronically through the EB1 platform, and permits EB1 and its authorised partners to collect and rely on such electronic signatures where applicable.
If you do not consent to the electronic delivery of communications, you will not be able to access or use EB1 services.
By registering for an account, applying for a card, or otherwise accessing the EB1 platform, you acknowledge and agree that such actions constitute your electronic signature. You further agree that this Consent and any electronic signatures provided have the same legal effect as a handwritten signature.
Access to Paper Copies
You have the right to receive legal disclosures, notices, and communications (together, the “Covered Items”) in paper form by mail. EB1 may provide Covered Items to you electronically where:
You have provided your Consent to receive electronic communications; and
You meet the system requirements set out below.
For the purposes of this Consent, Covered Items include all legal disclosures, notices, servicing and collection communications relating to your account, and any other communications that EB1 is required to provide to you in writing.
Duration of Consent
Your Consent will remain in effect until the earliest of:
The termination of your account or participation in the program by you or by EB1; or
Your withdrawal of consent to receive electronic communications.
If your account is terminated, this Consent will continue to apply to communications, disclosures, and rights arising prior to termination, including any rights created by your agreement to this Consent, to the extent permitted or required by applicable law.
Methods of Providing Covered Items
For the purposes of this Consent, the term “provide” includes delivering, making available, sending, notifying, or using similar methods. EB1 may provide Covered Items electronically by making them available through the EB1 platform, by email, or through downloadable files, including PDF documents.
It is your responsibility to review Covered Items promptly and to take any required action within applicable timeframes.
You may retain copies of Covered Items by using the print or save functionality available through the application or software used to access them (such as a web browser or PDF viewer). EB1 will retain copies of Covered Items for the periods required by applicable law, as set out in the Privacy Policy, and will provide copies upon request during those periods.

Our Right to Send Paper
EB1 reserves the right, at its sole discretion, to provide Covered Items in paper form at any time, even if you have provided Consent to receive such communications electronically.
Without limitation, EB1 may elect to provide Covered Items in paper form where:
Electronic systems are unavailable or disrupted; or
EB1 reasonably suspects fraud, unauthorised activity, or security concerns.
Hardware and Software Requirements
To access, receive, and retain Covered Items electronically, you must have access to a computing or communications device that meets the following requirements:
Reliable internet access
A current web browser that supports modern encryption standards (such as the latest versions of Chrome, Firefox, Microsoft Edge, or Safari)
Sufficient device memory and storage to load, view, and retain electronic documents
Software capable of viewing, saving, and printing PDF files (such as Adobe Reader or equivalent software)
By providing your Consent, you confirm that you meet these hardware and software requirements and are able to access and retain electronic communications.
Withdrawing Consent
You may withdraw your Consent at any time, free of charge. However, withdrawing Consent prior to the approval of your application, or during your use of the services, may prevent you from accessing or continuing to use EB1 services.

Withdrawal of Consent does not affect the legal effectiveness, validity, or enforceability of any electronic communications, disclosures, or agreements provided or entered into prior to the withdrawal.

You have access to a computing system that meets the hardware and software requirements described above;
You consent to receiving Covered Items electronically; and
You are able to access, review, print, and retain electronic communications and documents provided to you.
