EB1 provides access to a suite of premium lifestyle and financial-technology services, which may include:
Concierge and lifestyle facilitation services
Technology solutions that enable users to access digital wallet and account-based services provided by regulated third-party providers
Access to card-based products and payment features made available by licensed third-party issuers
Supporting technology, interfaces, and infrastructure that facilitate access to payment-related services
EB1 does not itself provide regulated financial services, issue cards, process payments, or hold, safeguard, or control customer funds. Any regulated financial services are provided by appropriately authorised third-party providers and are subject to their own terms, conditions, and regulatory obligations.
All services are subject to applicable regulatory requirements, third-party dependencies, and internal approval processes. Availability, features, and functionality may vary depending on jurisdiction, eligibility, and regulatory status..
Eligibility
To use EB1 services, you must:
Be at least 18 years of age or have reached the age of majority in your jurisdiction
Successfully complete applicable identity verification (KYC) and onboarding checks, whether conducted by EB1 or its authorised third-party service providers
Satisfy applicable anti-money laundering, counter-terrorist financing, and sanctions screening requirements
Not be located in, resident in, or otherwise connected to any sanctioned country or jurisdiction
Not be designated on any applicable sanctions lists, including (without limitation) those maintained by OFAC, the European Union, or the United Nations
EB1 reserves the right, at its sole discretion, to refuse, suspend, or terminate access to its services where eligibility or compliance requirements are not met or can no longer be satisfied.
Fees & Payment
Fees applicable to EB1 services may vary depending on the products, features, and services you access and may include:
Platform, access, or service fees charged by EB1
Fees for premium concierge and lifestyle facilitation services
Foreign exchange or cross-border conversion fees charged by third-party service providers, where applicable
Transaction-related, late payment, or returned payment fees imposed by third-party issuers or service providers in accordance with their own terms
All applicable fees will be disclosed to you prior to your use of the relevant service. By proceeding, you agree to pay all applicable fees in accordance with the terms presented at the time of service, whether charged by EB1 or by third-party providers.
EB1 may amend its own fee structure upon prior notice. Continued use of the services following any fee change constitutes acceptance of the revised fees
User Obligations
As a condition of accessing or using EB1 services, you agree to:
Provide accurate, current, and complete information during onboarding and throughout your relationship with EB1
Promptly update any information that becomes inaccurate, incomplete, or outdated
Use the services in compliance with all applicable laws, regulations, and regulatory requirements
Refrain from engaging in any prohibited, unlawful, or abusive activities, including money laundering, terrorist financing, fraud, or any other illegal conduct
Maintain the confidentiality and security of your account credentials and access devices
Notify EB1 without undue delay of any unauthorised access, suspected misuse, or compromise of your account
Use the services solely for their intended personal or business purposes and in accordance with these Terms
Failure to comply with these obligations may result in restriction, suspension, or termination of access to EB1 services, without prejudice to any other rights or remedies available to EB1.
Risk Disclosure
You acknowledge and accept that:
Transactions may be delayed, declined, restricted, or reversed for compliance reasons, including anti-money laundering, sanctions screening, fraud-prevention, or operational requirements
EB1 and/or its authorised third-party service providers may carry out ongoing monitoring and may request additional information or documentation from you at any time
Regulatory requirements may change, which may affect the availability, functionality, or nature of services
Digital asset values can be volatile and may fluctuate significantly
Transaction processing times may vary due to network conditions, third-party dependencies, or regulatory requirements
EB1 will use commercially reasonable efforts to notify you of material issues affecting your use of the services; however, uninterrupted or error-free service cannot be guaranteed.
Liability Cap
To the maximum extent permitted by applicable law, EB1’s total aggregate liability to you for any claim, loss, or damage arising out of or in connection with these Terms or the services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to direct damages not exceeding the total Membership fees actually paid by you to EB1 in the twelve (12) months immediately preceding the event giving rise to the claim.
In no event shall EB1 be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including (without limitation) loss of profits, loss of data, loss of use, or loss of goodwill, even if EB1 has been advised of the possibility of such damages.
Indemnity
You agree to indemnify, defend, and hold harmless EB1, its affiliates, directors, officers, employees, agents, and partners from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees and expenses) arising out of or in connection with:
Your access to, use of, or misuse of the EB1 services
Your breach of these Terms & Conditions or any incorporated policies
Your violation of any applicable laws, regulations, or regulatory requirements
Any unlawful, fraudulent, or prohibited activity carried out through your account or in connection with your use of the services
Any third-party claims arising from your acts or omissions
Force Majeure
EB1 shall not be liable for any delay, failure, or interruption in the performance or availability of the services where such delay, failure, or interruption results from events or circumstances beyond its reasonable control, including (without limitation):
Acts of God, natural disasters, or severe weather events
War, terrorism, civil unrest, or acts of government or regulatory authorities
Network outages, cyber incidents, system failures, or infrastructure disruptions
Pandemics, epidemics, or public health emergencies
Changes in applicable laws, regulations, or regulatory requirements
Failures, delays, or interruptions affecting third-party service providers or infrastructure
In the event of a force majeure occurrence, EB1 will use commercially reasonable efforts to restore the availability of the services as soon as reasonably practicable.
Governing Law & Dispute Resolution
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), excluding its conflict of law rules.
Any dispute, controversy, or claim arising out of or in connection with these Terms or the services shall first be referred to good-faith negotiations between the parties for a period of thirty (30) days.
These Terms and Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the substantive laws of the Dubai International Financial Centre (DIFC), without regard to its conflict of laws principles.
Each party irrevocably agrees that the courts of the Dubai International Financial Centre (DIFC Courts) shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or their subject matter or formation. Nothing in this clause shall limit the right of EB1 to take proceedings against the Customer in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
The parties hereby elect and agree in writing that any claim or dispute (including non-contractual disputes or claims) where the amount or value in dispute does not exceed AED 500,000 (excluding interest, costs, and fees) shall be referred to and finally resolved by the DIFC Small Claims Tribunal (SCT) in accordance with its rules and procedures.
The arbitration shall be conducted in English. The seat and legal place of arbitration shall be Dubai, United Arab Emirates.
Nothing in this section shall prevent EB1 from seeking interim or injunctive relief from the DIFC Courts where necessary to protect its rights or interests.
Changes to Terms
EB1 may amend, modify, or update these Terms & Conditions from time to time. Where changes are material, EB1 will provide reasonable prior notice through one or more of the following channels:
Email to your registered email address
In-app notifications or platform announcements
Updates published on our website
The updated Terms will take effect on the date specified. Your continued access to or use of the services after the effective date constitutes acceptance of the amended Terms. If you do not agree to the changes, you must discontinue use of the services.
Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be severed or, to the extent necessary, modified to render it valid and enforceable, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms & Conditions, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and EB1 in relation to the subject matter hereof and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
